Terms & Conditions

§ 1 Scope

These Terms and Conditions ("T&Cs") apply to all contracts for the use of the Android application "Juno Launcher" ("App") between Daniel Möck ("Provider") and the customers ("User").

§ 2 Subject of Contract and License Rights

(1) The Provider provides the App as a simplified home screen for Android mobile devices. The range of functions is based on the current description in the Google Play Store or the official website.

(2) With the purchase of the App (one-time purchase), the User receives a simple, non-exclusive, unlimited in time, and non-transferable right to use the App on their personal Android devices.

(3) The User has no claim to the permanent provision of free feature updates, although the Provider aims to release regular maintenance updates to fix errors.

§ 3 Purchase and Payment (Google Play Store)

(1) The App is usually purchased through the Google Play Store. Google's terms of use and payment terms apply.

(2) After the one-time purchase, the User does not incur any recurring subscription costs for the core functions of the App described.

§ 4 Limitation of Liability

(1) The Provider is liable without limitation for damages resulting from injury to life, body, or health, as well as in cases of intent and gross negligence.

(2) In the event of a breach of essential contractual obligations (cardinal obligations), the Provider shall only be liable for typical, foreseeable damage in cases of simple negligence.

(3) In particular, the Provider is not liable for damages caused by the emergency function (SOS button) not executing properly due to network failures, incorrect device system settings, lack of GPS signal, or hardware defects of the user's terminal. The App does not replace a professional home emergency system.

§ 5 Right of Withdrawal

As a consumer, when purchasing digital content via the Google Play Store, you are entitled to the statutory right of withdrawal in accordance with Google's guidelines. A refund request is processed directly via the Google Play Store.

§ 6 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Insofar as legally permissible, the place of jurisdiction for all disputes is Hamburg.
